Communiqué on Amendment to the General Communiqué /Seral No:19) on the Financial Crimes Investigation Board (Serial No: 24)” (the “Communiqué”) has been published in the Official Gazette dated 11 August 2023 and numbered 32276, by the Ministry of Treasury and Finance.
With the relevant the Communiqué, while previously artificial intelligence applications for remote identity verification were only allowed for natural persons or sole proprietors in continuous business relationships, a provision has been introduced to enable the use of these artificial intelligence applications for legal entities registered in the commercial registry as well.
On the other hand, taking into account that remote identification is a technology-intensive practice, in cases where artificial intelligence applications are utilized for remote identity verification, technical reporting conditions have been established, and a certification requirement related to security management systems has been set forth to ensure the necessary security in outsourcing services.
Some of the basic considerations in the sectoral regulations of the financial institutions within the scope of the Communiqué, which constitute a general standard in remote identification, have been included in the scope of the Communiqué, which is a framework regulation covering all sectors.
Additionally, the Communiqué sets forth the procedures and principles regarding the remote identification of the real person representatives of legal entities. In these principles, it is required that the trade registry records and the information of the real person representatives are compatible.
