The Ministry of Trade (the "Ministry") has published the “Regulation Amending the Regulation on the Trade of Second-Hand Motor Land Vehicles” (the "Regulation") in the Official Gazette dated 6 July 2023 and numbered 32240.
With the relevant Regulation, the Ministry restricted the marketing of vehicles through advertisements at a price above the current sales price recommended by the manufacturer or distributor until 1 January 2024.
Within this framework, real persons or legal entities that mediate the advertisement for the sale of second-hand motor vehicles are obliged to warn those who advertise second-hand vehicles with a price above the recommended current sales price before the advertisement is published and to convey all information regarding the advertisements and advertisers to the Ministry in accordance with the requests of the Ministry.
Furthermore, the Ministry is authorized to determine the class, brand, type, kind, model year and the maximum amount and/or rate of second-hand motor land vehicles that may be added to the current sales price recommended by the manufacturer or distributor in case of the addition of accessories and/or equipment under the Regulation.
The Regulation will enter into force on 15 July 2023 and it is understood that the sales market of the second-hand motor land vehicles will be kept under control by the Ministry as of this date.
