Presidential Decree (the “Decree”) on the extension of the duration of the short-time working allowance for the workplaces where short-time working is applied on the grounds of regional crisis due to the Kahramanmaraş-based earthquakes occurred on 6 February 2023 has been published in the Official Gazette dated 29 July 2023 and numbered 32263.
As per the Decree, within the framework of the principles set out in the Law of Unemployment Insurance Law numbered 4447, it has been regulated to extend the duration of the short-time working allowance until 7 August 2023 without the need for a new eligibility determination for the workplaces applied for short-time working allowance until 8 May 2023 on the grounds of regional crisis as a result of the earthquakes that occurred on 6 February 2023 (i) for the workplaces whose short-time working practice ended on or before 8 May 2023 and (ii) for the workplaces whose short-time working practice ended after 8 May 2023 as of the date following the short-time working end date.
The Decree also regulates that employers may benefit from the extension of the duration providing following conditions of (i) the employer's application and (ii) the continuity of the same conditions for employees who have previously benefited from short-term work must be met together.
Additionally, it has been decided that the payments made due to the regional crisis caused by the earthquake centered in Kahramanmaraş will not be deducted from unemployment benefit duration which is initially determined.
The relevant Decree has entered into force on the date of its publication, effective from 9 May 2023.
